Recognizing the importance of increased transparency and the need to rebound from the ``enclosure'' described above, there has been an increasing interest in the use of disclosed and open source software in U.S. elections. Some efforts involve creating or procuring open source voting systems and others are moves by the government to mandate increased source code disclosure to promote either transparency or security goals or both. At least three projects -- one international -- have either used an open source-based voting system in an election or aim to produce one. In the area of regulation, we discuss the State of California's mandate that a specific piece of election system software use open source code. Finally, we discuss pending bills in Congress and pending and enacted state laws that stipulate some level of disclosed source code for voting systems.
